Delainey’s Commission T.O.S.

Here I have some Terms Of Service outlined here just to keep both myself, the artist, and you, the client on the same page. I highly recommend taking a close look at all of my terms and conditions to prevent any misunderstandings or to answer any questions you may have!

Before You Read:

When commissioning me, you’ve agreed to all of my terms of service, even if you have not read them!
I’m willing to work with several forms of payment methods. (The current ones I have set up are Paypal, Stripe, Square, Cashapp, and Venmo.)
Please be respectful to me and my TOS; a little bit of respect goes a long way.
Before moving forward, please Do Not Interact (DNI) with me if you support and/or take part in any of the following:
-Hate speech, racism, homophobia, transphobia, anti LGBTQIA+ , ableism, pro-ship, pedophilia, zoophilia, noncon (non consensual acts), etc.

Please Read:

By commissioning me, you agree to the following:-I have the right to refuse or cancel the process of any commission at my own discretion. Please do not submit payment before I have fully accepted your commission request.
-You cannot sell or redistribute my work without my permission
-You may not alter the commissioned artwork (recoloring, removing my watermark, etc.) unless I have given explicit permission to do so. Please approach me if you want to request a simple recolor or any small update or change.
-You must credit my work if you share or post it anywhere online
-My art will be drawn in my own style, not explicitly for the purpose of imitating others
-I have full rights to use my artwork however I like, which includes sharing my art online and using it for examples
-I require full payment upfront, or within 48 hours
-I will NOT accept full refunds after I have started the sketch of a piece (only up to 80%), and NO refunds after I’ve started the lineart. I deserve to be paid for my time.
-Chargebacks made on finished pieces are NOT allowed. Doing this will result in the commissioner being blacklisted.
-My art is NOT to be used for any AI generation purposes or fed into any AI algorithms. My art cannot be made into an NFT or minted. My art is NOT to be used in blockchains, NFTs, or anything crypto or blockchain-related.
-All personal and private information between myself and the client is confidential.
-I accept payment through PayPal, Stripe, Square, Cashapp, and Venmo. Any other banks' apps or methods may be discussed.
-I do not accept other currencies or payment methods such as e-checks, cryptocurrency, or anything in the vein of Robux or DA points. USD only.
What I will draw:
-Animals (ferals), furries (anthros), humans/humanoids, and any other species (I don’t have any animal phobias, either. No species are off limits!)
-Other people's OCs -- *only with permission!
-Fanart/fan-made characters (this can be from movies, games, comics, TV shows, other existing media, etc.)
-Pets/pet portraits; especially dogs and cats (I can do semi-realism — done in my style — if you’d like, or I can keep it cartoony)
-Light gore, pastel/candy gore, scars, etc.
-SFW art
-SFW couples art, LGBTQ+ friendly art (including flags and symbols)
I MIGHT DRAW:
-Extreme gore, body horror themes (depends on the character, just ask first!)
-Highly complex or detailed designs (think Genshin Impact characters or similar)
-Robots, mechas, or super mechanical designs
-Some drug use (alcohol, weed, hallucinogens, generic pills and such)
-Artistic nudity
-Most weapons (firearms, knives, nail bats, swords, etc.)
What I will NOT draw:
-Other people’s characters without permission/stolen characters
-NSFW; sexual themes/symbols, fetishes, or explicit nudity
-Serious and sensitive topics or triggers such as // (TW for examples) // Self harm, EDs, etc.
-Anything that falls under my DNI list – especially anything hateful or offensive


Privacy:

All personal information must remain confidential between myself and the client.

About The Process:

I require all details for the commission upfront. Including character reference images, the commission type, and whatever specific details you may want to include. I will provide my information of your preferred payment to you after the commission information/details have been finalized. After this point, you will be expected to pay in full within 48hrs.I will send in a sketch wip for approval, and any subsequent progress updates/wips if they are requested. While I do encourage commissioners to ask for updates; Please do not message daily for them.I’ll request you to provide somewhere for me to send the final artwork in high quality, such as an email, through Google Drive or other methods.Most backgrounds can be provided for no extra cost unless it becomes too detailed, or if it is part of a “scene” piece. There are several options such as a gradient, flat color, simple pattern(s), transparent (no background), or 1 royalty-free image of choice. My go-to websites for royalty-free images are Pexels and Unsplash, though there are plenty more to find on the internet.I should be finished with a piece at an estimate of 1-3 weeks after payment (more or less) if I have a cue of commissions set up. I will let you know what timeframe I may have in mind when you commission me. I'm trying to prioritize my mental health, so please be patient with me!The final art may be edited if there is a small error or mistake that I have made. (This doesn’t include information left out at the time of the request.) If there are any small details you'd like changed long after a commission has been finished, I may be willing to help.

Payment/Refunds:

My prices are in USD only, therefore, I do NOT accept e-checks, cryptocurrency, or other digital currency such as DA points or Robux.Tips are always appreciated, but never expected!I currently accept payments through PayPal, but I am now also accepting payment through Stripe, Square, Cash-app, and Venmo. I’m new to these apps, so bare with me as I get used to using them! If you do not accept payment through any of these options, please let me know and maybe we can work something else out!

It is preferred that you submit the full payment upfront. I will not begin the commission until after it has been paid for. I’m willing to allow payment plans for pieces $100 and above, although it is preferred that I receive payment in full before I start drawing. This is to prevent getting myself scammed, which is unfortunately common. If I do not feel comfortable going forward with a payment plan, I’d recommend holding off on a commission until it can be paid in full. Please do not buy a commission if you don't think you can afford it!If I do not receive full payment upon request after 48 hours, your commission must be terminated. You may only receive a full refund if I have not started your commission or if I am unable to complete it. If I HAVE started your commission, and you decide not to follow through with it, there will be NO refunds once I have begun the lineart process! You may be able to receive a partial refund up to 80% if I have only started or completed the sketch. This will depend on how many revisions I’ve made to the sketch, how much time I’ve spent on it, etc.If you send a chargeback on a completed piece, you will be blacklisted from commissioning me again. This is a scam, and I will not tolerate being taken advantage of for my time and skills.
